Council is considering a rezoning application to permit additional uses, increase permitted floor area, and amend the applicable design guidelines.

Official Community Plan Bylaw, 2012, Amendment Bylaw (No. 16) No. 17-007

The purpose of this Bylaw is to amend the Official Community Plan by adding new design guidelines (the “Dockside Green Urban Design Guidelines (2016)” and the “BETA at Dockside Green Design Guidelines (2016)”) to Development Permit Area 13: Core Songhees that will apply to the development of certain lands within the area marked “Dockside” in Map 64 of the Official Community Plan, and to exempt the subdivision of lands within the area marked “Dockside” in Map 64 of the Official Community Plan from the requirement for a Development Permit provided the subdivision is consistent with the Subdivision Plans set out in Appendix A to the Dockside Green Urban Design Guidelines (2016). The new Design Guidelines and the exemption of subdivisions from the requirement for a Development Permit will apply to the lands legally described below in the notice concerning Zoning Regulation Bylaw, Amendment Bylaw (No. 1076) – Bylaw No. 17-005, and which are also shown outlined in the accompanying map.

Zoning Regulation Bylaw, Amendment Bylaw (No. 1076) No. 17-005

The purpose of this Bylaw is to amend Part 12.9 – CD-9 Zone, Dockside District, of Bylaw No. 80-159, the Zoning Regulation Bylaw, by deleting sections 1 through 13, as well as Schedules A and B, and substituting the Regulations and Schedules set out in Appendix 1 to Bylaw No. 17-005. The Bylaw will alter the CD-9 Zone Regulations only as they apply to the lands shown outlined in the accompanying map, the legal descriptions are:

For the lands described above, the Bylaw will, in general terms:

 

         Create new Development Area Sub-Areas and provide regulations for development within those Sub-Areas,

         Allow for an increase in the maximum height of residential buildings fronting Tyee Road and Esquimalt Road,

         Limit the transfer of floor area of certain uses within various Sub-Areas,

         Allow additional uses within certain Sub-Areas including Dockside BETA building, brewery, distillery, retail liquor store as an accessory to a brewery or distillery, kindergarten, seniors housing, and cultural facility,

         Allow additional floor area for residential uses within Sub-Area D1,

         Prohibit transient accommodation within a self-contained dwelling unit,

         Provide new parking regulations.

Victoria Housing Strategy Implementation - Removing Minimum Unit Sizes

 

Council is considering amending the Zoning Regulation Bylaw to remove minimum residential unit sizes in multi-unit residential zones.

A report recommending that Council consider the motion on the proposed mental health strategy, as presented by the Victoria Police Department during the January 9, 2017 Special Committee of the Whole meeting.

 

Recommendation: That Council lift the following postponement motions from the Table for further consideration:

1. Fund first year of police support for vulnerable population pilot project, $240,200 from 2016 surplus.

2. Subject to a report from police with regard to pilot project, to the satisfaction of the majority of Council, fund second year of pilot project, $240,200 from 2017 surplus.

3. That Council direct staff to allocate any remaining surplus from 2016 to the Buildings and Infrastructure Reserve.
